Terms of use

These terms are a contract between you and the operator of Thriving, identified in the Legal notice ("we", "us"). They cover the Thriving app and this website. By creating an account, or by using the app, you accept them. If you do not accept them, do not use Thriving.

1. Who can use Thriving

You must be at least 16 years old and able to enter into a contract. You must give accurate account details and keep them current. One account is for one person; you are responsible for everything that happens under it, so keep your sign-in secure and tell us promptly if you think it has been compromised.

2. What Thriving is

Thriving captures what you tell it by voice, text, photo or connected account, uses AI to propose structure for it, stores the result, and reminds you about it. It is a tool that helps you organise your own life. It is not an agent that acts for you, and it does not act outside the app without your instruction.

Thriving is in early access. It is under active development: features will change, be added or removed, and occasionally break. We may change, suspend or discontinue any part of the service, including free features, at any time. Where a change materially reduces what a paid plan offers, we will tell you in advance and you may cancel.

3. Your content

Everything you put into Thriving — recordings, notes, documents, connected-account data and the items created from them — remains yours. You grant us only the licence needed to run the service for you: to store your content, process it (including through third-party AI providers acting on our instructions), produce suggestions from it, back it up, and show it back to you. We do not use your content to train AI models, we do not use it to advertise, and we do not sell it. This licence ends when the content is deleted, subject to the retention periods in the privacy policy.

You are responsible for your content. You confirm that you have the right to upload what you upload, including where it contains information about other people, and that you will not use Thriving to store or process anything unlawful.

4. AI: what it does, and what you must still do

Thriving uses AI to transcribe, read and interpret what you give it. AI makes mistakes: it can misread a date, an amount, a name or a deadline, miss an item entirely, or invent one that was not there. Everything it produces is a proposal for you to check and confirm. You are responsible for checking dates, amounts, deadlines and other details before relying on them, in the same way you would check a note from a colleague.

Thriving does not provide legal, financial, tax, medical or other professional advice, and nothing it produces should be treated as such.

5. Reminders are a convenience, not a guarantee

Reminders and notifications depend on your device settings, your network, Apple's notification service, and on the item having been captured and confirmed correctly. We do not guarantee that any reminder will be delivered, or delivered on time. You remain responsible for your own obligations — paying bills, meeting deadlines, attending appointments, renewing contracts — whether or not Thriving reminded you.

6. Connected accounts

If you connect a Google account, you authorise Thriving to read the messages and calendar entries needed to find obligations, on the read-only basis described in the privacy policy. Your use of Google services remains subject to Google's own terms. You can disconnect at any time. We are not responsible for the availability of third-party services or for changes they make that affect Thriving.

7. Acceptable use

You agree not to:

  • use Thriving for anything unlawful, or to store or distribute unlawful material;
  • upload other people's personal data that you have no right to hold;
  • attempt to gain unauthorised access to the service, other accounts or our systems;
  • probe, overload, disrupt or reverse engineer the service, or extract its models, prompts or source code;
  • use automated means to access the service other than through interfaces we provide;
  • circumvent usage limits, including by creating multiple accounts;
  • resell, sublicense or redistribute the service or any part of it.

Free features are subject to fair-use limits, which we may set and adjust. We may suspend or terminate an account that breaches this section.

8. Plans, trials and payment

Some features are free; others require a paid plan. The plans, prices and what each includes are shown in the app and at the point of purchase. Prices are shown in your local currency including applicable taxes where the store requires it.

App Store. Subscriptions bought in the iOS app are billed by Apple to your Apple account, on the terms shown at purchase. They renew automatically at the end of each period unless you cancel at least 24 hours before it ends, and you manage or cancel them in your Apple account settings, not in Thriving. Where a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled before then. Refunds for App Store purchases are decided by Apple under Apple's policies; we cannot issue them.

Web checkout. Where we offer subscriptions on our website, payment is processed by Stripe. Subscriptions renew automatically unless cancelled before the end of the current period, and you can cancel from your account at any time; cancellation takes effect at the end of the paid period. If you are a consumer in the EU or UK, you have a 14-day right of withdrawal; by asking for immediate access to the paid features you agree that the service begins at once and that you lose the right of withdrawal once it has been fully performed, and you owe a proportionate amount for the period used.

Price changes. We may change prices. A change applies to an existing subscription only from the next renewal after we have given you notice, and you may cancel before then.

Deleting your account does not cancel an App Store subscription; cancelling a subscription does not delete your account or your data. Both are explained in the app.

9. Ending the relationship

You can stop using Thriving and delete your account at any time from Settings → Privacy & Data. Export your data first if you want to keep it; after deletion it cannot be recovered.

We may suspend or terminate your account if you breach these terms or the law, if we are required to by law, or if your account has been inactive for more than 24 months. We will tell you why where the law allows and, except in cases of serious breach, give you a reasonable opportunity to export your data.

If we discontinue Thriving altogether, we will give you at least 60 days' notice, a way to export your data, and a pro-rata refund of any prepaid period we do not deliver.

10. Our intellectual property

Thriving, its software, design, text, illustrations, models, prompts and trademarks belong to us or our licensors. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on Apple devices you own or control, for your own personal, non-commercial use, in line with these terms and the App Store's usage rules. Nothing in these terms transfers any of our rights to you.

If you send us feedback or suggestions, we may use them without any obligation to you.

11. No warranty

Thriving is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including as to accuracy, reliability, availability, fitness for a particular purpose or non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, that AI output will be correct, or that any item, deadline or obligation will be captured, extracted or surfaced.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, data, business or goodwill, arising from your use of or inability to use Thriving. In particular, and without limiting the above, we are not liable for any loss arising from a missed, late, incorrect or undelivered reminder, an inaccurate AI proposal, an incorrectly extracted date or amount, a missed payment, deadline, appointment or renewal, or the acts or omissions of a third-party service.

Our total liability to you for all claims arising out of or relating to Thriving in any twelve-month period is limited to the greater of CHF 100 and the amount you paid us in the twelve months before the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, or for death or personal injury caused by negligence. If you are a consumer, you keep the mandatory protections of the law of the country where you live.

13. Your responsibility to us

If a third party brings a claim against us because of content you uploaded in breach of section 3 or 7, or because of your unlawful use of Thriving, you will compensate us for the reasonable costs and damages that result, to the extent the law allows.

14. Third-party services

Thriving relies on third-party services — Apple, Google, AI providers, hosting and payment providers — listed in the privacy policy. Their terms apply to your use of their services, and we are not responsible for their availability, performance or changes.

15. App Store terms

These terms are between you and us, not Apple. Apple is not responsible for Thriving or its content, and has no obligation to provide maintenance or support for it. To the extent the law allows, Apple has no warranty obligation for the app; if the app fails to conform to a warranty that cannot be excluded, you may notify Apple and Apple will refund the purchase price of the app to you, and Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, or consumer-protection claims. We, not Apple, are responsible for investigating, defending and settling any claim that the app infringes a third party's intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with Apple's Licensed Application End User License Agreement usage rules.

16. Changes to these terms

We may change these terms. For a material change we will tell you by email or in the app at least 30 days before it takes effect, unless the change is required by law or addresses a security or abuse issue, in which case it may take effect immediately. Continuing to use Thriving after the change takes effect means you accept the new terms; if you do not, cancel and delete your account before then.

17. Law and disputes

Swiss law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The courts at our registered seat in Switzerland have exclusive jurisdiction, subject to any mandatory rule that gives you, as a consumer, the right to sue or be sued in the courts of your own country. If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform; we are not obliged to and do not participate in alternative dispute resolution before a consumer arbitration body.

18. General

If part of these terms is found invalid, the rest remains in force. Our not enforcing a term is not a waiver of it. You may not transfer your account or these terms to anyone else; we may transfer them to a successor of the business, and will tell you if we do. These terms, together with the privacy policy, are the whole agreement between you and us about Thriving. The English version is the binding one.
